The Embodied Coaching Certification Terms and Conditions

These Terms and Conditions ("Agreement") govern participation in the programs, courses, and workshops offered by Humanity Shared, LLC (referred to as "Humanity Shared"). By enrolling in any Humanity Shared program, the participant agrees to abide by the terms outlined below.

1. Program Scope and Participation

Participants enrolling in the Humanity Shared coaching program will receive:

  • A maximum 12-month program duration.
  • Access to all EmC I online course materials.
  • Comprehensive EmC I course content and supporting materials.

2. Eligibility and Prerequisites

To enroll in this program, participants must meet the following requirements:

  • Must be 18 years of age or older.
  • Must be proficient in English.
  • EmC II enrollment requires prior certification in EmC I.

3. License and Access

  • Participants have access to EmC I online materials for a maximum period of 12 months or until certification is granted.
  • The license is strictly non-transferable.
  • Humanity Shared reserves the right to update or modify course materials at any time.

4. Payment and Refund Policy

  • Participants may choose to pay in full at the time of enrollment or select a payment plan, if available. By enrolling in the program, participants agree to pay the full program fee, regardless of whether they complete or withdraw from the program.
  • No refunds will be issued after payment is made. Participants who choose a payment plan are still responsible for completing all scheduled payments as agreed.
  • Payment and/or participation in the program does not guarantee EmC I certification.

5. Certification Requirements

To earn certification, participants must:

  • Complete all required coursework, including any practice hours.
  • Submit a final video assignment for review by the Humanity Shared leadership team.
  • Allow up to four (4) weeks for the review process, with potential additional revisions if necessary.

Certification Renewal

To renew certification, participants must:

  • Pay a $250 renewal fee.
  • Submit a 15-25 minute video demonstrating continued proficiency in Embodied Coaching Skills.
  • Complete 10 or more hours of Humanity Shared programming (online or in-person) within a two-year period.
  • Humanity Shared reserves the right to deny renewal if video exam requirements are not met.

6. Intellectual Property and Copyright

  • Course materials are protected by copyright laws.
  • Participants may not record, distribute, or share course materials without explicit written consent.

7. Attendance and Participation

  • Full attendance at scheduled weekend training (hybrid or in-person) is required to take the final exam.
  • Participants unable to attend may reschedule within 365 days of original enrollment, subject to approval.

8. Technical Requirements

  • A computer with a reliable internet connection is required.
  • Participants must have a video recording device for certification assignments.

9. Disclaimers and Limitation of Liability

  • Humanity Shared is not responsible for any physical, emotional, or financial consequences resulting from participation in the coaching program.
  • The program is for educational purposes only and does not constitute therapy, counseling, or professional mental health services.
  • Waiver of Liability: In consideration of being allowed to participate in Humanity Shared's program, I, for myself and on behalf of my heirs, assigns, personal representatives and next of kin, hereby release, indemnify, and hold harmless Humanity Shared, its officers, agents, employees, volunteers, and representatives from any and all claims, demands, losses, and liability arising out of or related to any injury, disability, or death I may suffer, or loss or damage to property, whether arising from the negligence of Humanity Shared or otherwise, to the fullest extent permitted by law.

10. Retreat Terms & Conditions

  • If a participant does not attend an EmC-eligible retreat, they must complete all required online courses as specified on the Kajabi platform.

11. Privacy Policy

  • All personal information collected during enrollment and participation will be handled in accordance with applicable privacy laws.

12. Jurisdiction

  • Any disputes arising from this Agreement will be resolved in accordance with the laws of the state of Colorado.

13. Media Release
By participating in any Humanity Shared program, including but not limited to trainings, retreats, workshops, and online or in-person sessions, the Participant grants Humanity Shared the irrevocable right and permission to capture, record, and use photographs, video footage, and audio recordings that include the Participant. This media may be used, reproduced, edited, published, and distributed by Humanity Shared for any lawful purpose, including but not limited to promotional materials, advertising, educational content, and social media platforms.
The Participant acknowledges that they will not receive any compensation for the use of such media and waives any right to inspect or approve the final product. All rights, title, and interest in the media shall belong exclusively to Humanity Shared. This release applies in perpetuity and is binding upon the Participant and their heirs, legal representatives, and assigns.

PERMISSION TO USE RECORDED CONTENT

By signing this Agreement, the participant ("Participant") grants Humanity Shared permission to use any recorded content featuring or created by the Participant, including but not limited to:

  • Audio and video recordings
  • Photographs
  • Written materials

1. Purpose of Use

Humanity Shared may use the recorded content for lawful purposes, including:

  • Marketing and promotional activities
  • Educational or informational content
  • Distribution and sale of products or services

2. Rights and Ownership

  • Humanity Shared retains the right to edit, modify, and distribute content.
  • The Participant waives any claim to compensation or royalties.
  • Humanity Shared has full ownership of the content upon signing this Agreement.

3. Duration of Permission

  • This permission is granted indefinitely and does not require renewal.

4. Voluntary Participation

  • The Participant confirms their involvement is voluntary, without coercion or expectation of payment.

ATTENDANCE THRESHOLD POLICY

  • If one of the scheduled training weekends does not meet the minimum required number of attendees, we will consolidate all registered participants into a single training weekend.

 

CANCELLATION POLICY

  • All payments are non-refundable and non-transferable.
  • Payment is required at the time of registration.
  • No credit will be provided for future Humanity Shared offerings if a participant cancels their booking.

PERSONAL RESPONSIBILITY

  • Participants are responsible for ensuring they are physically and mentally capable of participating.
  • Humanity Shared reserves the right to refuse participation if a guest is deemed physically or mentally unfit.
  • Participants understand that emergency contacts, not Humanity Shared, are responsible for handling emergencies, including law enforcement and medical situations.

DISMISSAL FROM PROGRAMMING

Humanity Shared reserves the right to dismiss any participant for:

A. Illegal or Illicit Substance Use

  • Use of illegal substances or participation in illegal activities will result in immediate dismissal.
  • Humanity Shared is not responsible for any legal or medical costs incurred.
  • Participants will be invoiced for any costs incurred by Humanity Shared due to their actions.

B. Intimidating or Threatening Behaviors

  • Any intimidation, threats, or violent behaviors will result in dismissal.
  • Humanity Shared is not responsible for any costs incurred due to these actions, including medical or legal fees.
  • Participants are responsible for any damages and will be invoiced accordingly.

KNOWING AND VOLUNTARY EXECUTION

I have carefully read this Agreement and fully understand its contents. I acknowledge that:

  • This Agreement releases liability and forms a binding contract with Humanity Shared.
  • I sign it of my own free will.

ELECTRONIC SIGNATURE ACKNOWLEDGEMENT

By signing this Agreement, I understand that my electronic signature is legally equivalent to my handwritten signature, and I am legally bound by this Agreement.
